IMB – INDÚSTRIA METALÚRGICA LTDA is a company committed to privacy and the protection of personal data and, therefore, establishes with the holders of personal data (“HOLDERS”) the commitment to respect Brazilian and European personal data protection laws.

This Privacy and Data Protection Policy (“Policy”) is intended to inform HOLDERS about the measures used by IMB – INDÚSTRIA METALÚRGICA LTDA for the collection, storage, use or any other personal data processing operation carried out on its website.

IMB – INDÚSTRIA METALÚRGICA LTDA is not responsible for the collection and use of personal data or for the content of third-party websites.

IMB – INDÚSTRIA METALÚRGICA LTDA undertakes to use the personal data collected from HOLDERS for the following purposes:

• registration, quotes and/or orders;
• production of statistics regarding the activities and behavior of HOLDERS;
• adding content to the website and to the company's activities;
• responding to requests and questions about the products and services offered by IMB – INDÚSTRIA METALÚRGICA LTDA;
• dissemination of market content, as well as events organized and/or promoted by IMB – INDÚSTRIA METALÚRGICA LTDA;

The consent for the collection, storage and processing of HOLDERS' personal data, to meet the purposes proposed by IMB – INDÚSTRIA METALÚRGICA LTDA, is voluntary. Should HOLDERS decide not to consent to the collection of data, the only consequence will be the non-provision of the services and/or facilities proposed by IMB – INDÚSTRIA METALÚRGICA LTDA.

IMB – INDÚSTRIA METALÚRGICA LTDA will not process the personal data of its HOLDERS without their consent, except in the legal cases where it is necessary or mandatory, including:

IMB – INDÚSTRIA METALÚRGICA LTDA guarantees that it does not sell HOLDERS' personal data. However, HOLDERS' personal data may be shared with external agents, hired by IMB – INDÚSTRIA METALÚRGICA LTDA, to perform technical services and/or to support the company's activities, exclusively to achieve the purposes stipulated herein.

In respect of HOLDERS' personal data, IMB – INDÚSTRIA METALÚRGICA LTDA requires external agents to process the data in line with their own confidentiality and security parameters, observing this Policy.

HOLDERS have the right to request, at any time, access to the data and its portability, as well as to modify, correct, update, limit and delete their personal data collected by IMB – INDÚSTRIA METALÚRGICA LTDA.

HOLDERS may also object to the processing of data for legitimate reasons, as well as request the anonymization, blocking or elimination of data they deem unnecessary and/or excessive.

Should they wish, HOLDERS may request their removal from the mailing list of the IMB – INDÚSTRIA METALÚRGICA LTDA website, no longer receiving any informational e-mail or WhatsApp message.

To exercise their rights, HOLDERS must send an e-mail or letter/WhatsApp message with their request to the addresses provided below in item “6. Contact Information”.

IMB – INDÚSTRIA METALÚRGICA LTDA stores the collected personal data of HOLDERS securely, only for the period of time necessary to carry out the operations established herein, in compliance with European and Brazilian legislation, including the Brazilian Civil Rights Framework for the Internet (Marco Civil da Internet), which requires the storage of internet application access logs for a period of 6 (six) months.

Data related to customers is stored for the duration provided for by law and/or in the General Terms of Contract.

The storage of data will respect this Policy and/or any instruments entered into with HOLDERS. However, data may be stored for a longer period of time for legal reasons or by court order.

Under the terms of personal data protection legislation, should HOLDERS wish, they may revoke the consent previously granted to IMB – INDÚSTRIA METALÚRGICA LTDA for the processing of their personal data. This right must be exercised through the channel made available in item “6. Contact Information”.

IMB – INDÚSTRIA METALÚRGICA LTDA stores your data on its own servers and/or those of contracted partners, located in Brazil and/or abroad, as well as on cloud servers (cloud computing), so that the transfer and processing of HOLDERS' personal data outside Brazilian territory may occur.

IMB – INDÚSTRIA METALÚRGICA LTDA is committed to the security of the processing of users' personal data through the implementation of advanced information technology mechanisms, which adopt technical, physical and logical security procedures normally used by the market. These procedures aim to protect personal data against loss, misuse, alteration, destruction or leakage.

Any member of IMB – INDÚSTRIA METALÚRGICA LTDA who has access to the collected information is informed of its confidential nature, in addition to maintaining a commitment to act in accordance with this Policy.

HOLDERS must adopt the preventive measures necessary for the use of the internet, including the use of antivirus software, a personal access password and other technical and managerial measures, in order to avoid failures, intrusions or other inconveniences in accessing the tools made available by IMB – INDÚSTRIA METALÚRGICA LTDA, including the WhatsApp application, which is a tool used as a legal means of communication. IMB – INDÚSTRIA METALÚRGICA LTDA will not be responsible for any damages resulting from the exclusive fault of the HOLDERS and/or third parties.

Any complaint or communication from HOLDERS must be directed to the department identified above. The Officer is duly authorized by IMB – INDÚSTRIA METALÚRGICA LTDA to provide clarifications and/or take measures regarding the processing of personal data.

This Policy may be modified at any time, upon prior notice through the IMB – INDÚSTRIA METALÚRGICA LTDA website and/or electronic correspondence addressed to HOLDERS, to be sent to the e-mail provided to IMB or via the WhatsApp application.
